By visiting and using Shizzlr.com or any Shizzlr applications, you are agreeing to follow the rules and policies set forth by this Terms and Conditions document, abide by all applicable laws and regulations, including those of areas and bars with which you use Shizzlr. If you disagree with any of this, then you are not allowed to use any form of Shizzlr. Shizzlr may update these terms of use for its web site and applications at any time without notice. The Shizzlr website and other Shizzlr applications are protected by copyright and trade mark law. Any claim relating to Shizzlr's web site or applications shall be governed by the laws of the State of Connecticut.

2. Disclaimer

Your use of the Shizzlr web site and its applications is at your sole risk. Shizzlr is provided on an "as is" and "as available" basis. Shizzlr expressly disclaims all warranties of any kind, whether express or implied,including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Shizzlr makes no warranty that it or any of its services will meet your requirements. Shizzlr is not responsible for the accuracy or reliability of the information and materials on its web site or applications. Shizzlr is also not responsible for any information or material on any sites that link to Shizzlr.com or m.Shizzlr.com, and use of these linking sites is at the users own risk. Technical and typographical errors may appear on the Shizzlr web site and/or applications, and Shizzlr can not be held responsible for this. Shizzlr will update the web site and applications from time to time, but is not required to do so. Any material downloaded from Shizzlr onto a user's computer is at their own discretion and risk.

3. Limitations

Shizzlr and any of its third party suppliers can not be held liable for any damages that may occur due to the inability to use the Shizzlr web site or applications. Even if Shizzlr is notified of such inabilities, the previous statement still holds true.

4. Content

You understand that all information, data, text, photographs, graphics, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. With respect to Content you submit or make available for inclusion on publicly accessible areas of the Shizzlr web site and/or applications, you grant Shizzlr a world-wide, royalty free, non-exclusive license(s) to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Shizzlr web site and applications solely for the purpose for which such Content was submitted or made available. Members are allowed to add bars and event items to the Shizzlr database, which results in numerous new items being added to Web site and applications each day. Shizzlr does not control the Content posted by any user and thus does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will Shizzlr be liable in any way for any Content posted by any user or third party, including, but not limited to, liability for any errors or omissions in any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, e-mailed or otherwise transmitted via the Shizzlr web site or applications. "Publicly accessible" areas of the Shizzlr web site and applications are those areas intended by Shizzlr to be available to the general public.

5. User Conduct

You agree that you are responsible for establishing and maintaining your own profile information including what bars, friends, and towns you select to monitor and submit information to. Your use of the Shizzlr web site and applications is subject to your acceptance of, and compliance with this agreement. Shizzlr reserves the right, but does not assume the responsibility, to monitor or review your conduct on the Shizzlr web site and applications. Your use of the Shizzlr web site and applications is subject to all applicable federal, state and local laws and regulations, and you agree that the following activities are strictly prohibited in conjunction with your use of the Shizzlr web site and applications:

• Promotion or encouragement of illegal activity
• Interference with other Shizzlr users' use of the Shizzlr web site and applications
• Use of the Shizzlr web site and applications in violation of the rights of others
• Use of the Shizzlr web site and applications that is harmful to minors in any way
• The transmission, uploading, distribution or dissemination (or offer to do the same) of any unlawful, defamatory, harassing, abusive, fraudulent, infringing, obscene, or otherwise objectionable content
• Transmission of another's intellectual property or other proprietary information without permission
• Modification, adaptation, translation, or reverse engineering of any portion of the Shizzlr web site and applications or any software offered in connection with the Shizzlr web site and applications
• Transmission of email in violation of the CAN-SPAM Act or any other applicable anti-spam law
• The sale, exchange or distribution to a third party of the email addresses of any person without such person's knowing and continued consent to such disclosure
• The transmission of unsolicited emails to significant numbers of email addresses belonging to individuals and/or entities with whom you have no preexisting relationship
• Intentional distribution of viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items of a destructive or deceptive nature
• Impersonation of another person (via the use of an email address or otherwise) or other misrepresentation of yourself or the source of any email
• Creation of multiple user accounts in connection with any violation of the Agreement or creation of user accounts by automated means or under false or fraudulent pretenses
• The sale, trade, resale or other exploitation for any unauthorized commercial purpose or transfer any Shizzlr account
• Removal if any copyright, trademark or other proprietary rights notices contained in or on the Shizzlr web site and applications
• Provision of material or resources in support of any organization(s) designated by the United States government as a foreign terrorist organization

Violation of any of the foregoing may result in immediate termination of this agreement, and may subject you to state and federal penalties and other legal consequences. Your right to use the Shizzlr web site and applications is personal to you. You agree not to resell or make any commercial use of the Shizzlr web site and applications without the express consent of Shizzlr. You may not create bots or other computer generated automatic tools to create events or accounts, nor abuse the Shizzlr web site and applications in any manner. Use that constitutes abuse shall be determined by Shizzlr in its sole discretion. Shizzlr reserves the right to terminate your account if it determines you have not complied with any part of this agreement. You represent and warrant that you have all necessary right, power and authority to enter into this agreement and to perform the acts required of you hereunder.
